ADVERTISERS - Terms & Conditions

Click2Visit.com - website, add sites, advertisement and any features are provided and bound by Click2Visit Ltd Terms and Conditions and Disclaimer.

Agreement - shall become effective when the Client and Click2Visit Ltd have signed. Click2Visit Ltd is under no obligation to carry out any work in connection with the Client order until the Client has signed and returned the order of Agreement to Click2Visit Ltd.

Cancellation - If you wish to cancel,
a) You have 14 days from the agreement being signed in which to do so entirely without obligation, and any monies paid would be reimbursed. Cancellations by the Client must serve notice in writing by recorded delivery post to the address stated on the agreement.
b) Click2Visit Ltd reserves the right to cancel the information at any time without notice when no payments have been received on the due date or within 14 days [clause charges a, b, c].
c) If the Client does not wish for their advertisement to appear after the expire date of the initial advertising period the Client must serve notice in writing by recorded delivery post to the address stated on the agreement to the effect to the Click2Visit Ltd no later than 28 days notice before end of agreement, failing to do so will result in your advertising agreement continuing for a further period of time according to your agreement. If Click2Visit Ltd do receive your cancellation notice after the agreed 28 days notice period then you will be charged for a 1 month period in which your advertisement will continue to appear until the end of the 1 month period.
d) All free submissions can be cancelled or rejected at any time by Click2Visit Ltd without reason.

Payment - will be Cash, Cheque, Switch, Visa or Mandate Order in GBP [sterling].
a) Add Site / Advertisement - Deposit of 25% required than Full payment no later than 14 days after invoice date unless specified on the agreement and payment level [clause charges a, b, c].
b) Website/Design/Hosting/Training - Deposit of 25% required than Full payment no later than 14 days after invoice date unless specified on the agreement and payment level [clause charges a, b, c].
c) Added Extras - Full payment no later than 14 days after invoice date unless specified on the agreement and payment level [clause charges a, b, c].

Charges [non-payments, bank charges and our charges] -
a) Non payments on the due date or within 14 days thereafter then the whole of the balance outstanding under this agreement shall become due and payable with interest stipulated by S.69 of the County Courts Act 1984 from date of payment due, plus any costs that may be incurred by Click2Visit Ltd.
b) Click2Visit Ltd will charge the Client any costs incurred by any of the following, unpaid, returned or recalled bankers mandate/orders, unpaid returned or recalled cheques and any bank charges.
c) Any letters sent out as a result of non-payment and breach of agreement in line with our charging policy [further details on request].

New Rates [prices] -
a) Click2Visit Ltd has the right to increase add site and advertisement rates at any time. Click2Visit Ltd will honour the agreement period with the Client. New rates would only apply for the following period thereafter. The Client will be notified of these changes at least 28 days before agreement end.

Refunds -
a) In the event of impracticality on the part of Click2Visit Ltd, then a refund of any monies would be reimbursed to the Client.
b) Up to 14 days after signing the agreement any monies paid would be reimbursed.
c) After the expiry date [12 month agreement] - we will refund the relevant part of the monies received, if full payment was paid for the following 12 months after the 28 days notice [clause cancellation c]. All monthly payments will cease after the 28 days notice as expired.
d) Website/Design/Hosting/Training deposit paid will not be refundable after the 14 days.

Add Site / Advertisement / Website / Training -
a) Click2Visit Ltd reserve the right to produce the add site/advertisement/website in the manner and form it considers suitable, unless endorsed on the agreement and initialled by Click2Visit Ltd.
b) Add site and advertisement space and size maybe limited on certain pages or sections, so that effective look of the site is maintained and downloading is not effected. Click2Visit Ltd has the right to alter text size, shape and image size to preserve the structure of the site.
c) The Client will be allowed to view to there add site/advertisement/website on a test site before being transferred to the live site. The Client can request minor changes or identifies any errors in the proof [test site], then the Client will notify Click2Visit Ltd in writing to that effect at no additional charges. If the Client requests major changes at this stage, extra charges maybe incurred and part payment maybe requested, the Client will be provide with information beforehand.
d) Once an outline of the website as been structured and agreed upon by the Client and Click2Visit Ltd a deposit will be required [clause payment b] by Click2Visit Ltd.
e) Websites created will remain under the ownership of Click2Visit Ltd until full payment is received. Please note charges [clause charges a, b, c].
f) Click2Visit Ltd will include our Logo or Name [link] on the website as the creator of the site and would be placed in our portfolio with a link to your site from our portfolio unless specified in the agreement.
g) Click2Visit Ltd reserves the right to withhold, withdraw or refuse any add site/advertisement/website before final publication.
h) The Client can always upgrade on the package at anytime however the Client cannot down grade on package until the end of agreement and 28 days notice would be required, this would be through writing by recorded delivery post to the address stated on the agreement.
i) Where training as been requested by the Client from Click2Visit Ltd we will inform the Client of the charges beforehand and payment will be inline with our payment policy.
j) The Client may supply their own pre-formatted artwork and material, however such artwork and material must be in a format agreed with Click2Visit Ltd.
k) Click2Visit Ltd cannot be held responsible for the damage or loss of any material received from the Client. Click2Visit Ltd has the right to destroy all materials received from the Client after agreement end. The materials can be returned back to the Client at the Clients request and by pre-paid postage.
l) No Clients shall enjoy preferential position or monopoly rights by the Client unless endorsed on the agreement and initialled by Click2Visit Ltd.
m) No Adult material will be allowed or material that maybe offensive. If it is found or brought to our attention that your information as changed from the original intentions, you will be given notice to make the required changes within 7 days, if not corrected upon, all information will be removed. All payments received will not be refunded due to breach of agreement and a charge will be incurred in line with our charging policy [further details on request].
n) All correspondence, notices or other documents shall be deemed properly sent to the Client at the address given from Click2Visit Ltd at its trading premises Click2Visit Ltd, 25 Morston Avenue, Bispham, Blackpool, FY2 0TB [Or such other address as shall be notified to the Client].
o) Should Act of God, War on the Queen's enemies, or Act of Parliament or other Government action, strike, postal delay, extreme weather conditions, disaster conditions, or any other reasons beyond the control of Click2Visit Ltd we shall be excused from carrying out the conditions of the agreement until a normal situation prevails.

Client Liabilities -
a) The Client warrants that the advertisement comply with the British Code of Advertising Practice and do not contravene any of the provisions of the Trade Description Act 1968 and any Acts that have followed since. The Client will be responsible for and shall indemnify Click2Visit Ltd against any losses, damages, costs and expenses by reason or on account or any libel and infringement of copyright law of materials copied or supplied to Click2Visit Ltd by the Client. If Click2Visit Ltd is found liable to pay damages, costs or any expenses; the Client will be liable to pay that amount to Click2Visit Ltd.
b) The Client has the responsibility to ensure that the information they provide is correct throughout the Agreement term. The Client can make amendments to the information at any time and will be charged accordingly. The amendments by the Client must serve notice in writing by recorded delivery.
c) Where the business of the Client is taken over by a new proprietor or the nature of the business changes, the Client shall remain fully liable under this agreement, unless we are notified by recorded delivery post by the new proprietor of his / her intention to accept full responsibility, the terms already agreed with Click2Visit Ltd by the Client. Should the new proprietor default in any way of the agreement, the Client will remain liable for any loss incurred by Click2Visit Ltd. Click2Visit Ltd shall be entitled to remove the advertisement without obligation to refund any monies to the Client and also in the event of bankruptcy, winding-up, receivership, administration or acts of misconduct that could effect Click2Visit Ltd.

Complaints Procedure - Our aim at Click2Visit Ltd is to give excellent service to our Clients. If there is a reason for complaint the Client will be required to send a letter by recorded delivery post to Click2Visit Ltd with the nature of the complaint. We will try to resolve your complaint quickly and efficiently.

Law - This agreement/contract shall be in all respects be construed as an English agreement/contract subject to English Law.

Proceedings - Any proceedings of whatever nature in connection with or arising out of the agreement/contract shall be held at the County Court Blackpool, Lancashire or High Court / Registry at the discretion of Click2Visit Ltd.

Statutory Rights - Your statutory rights are not affected.

Disclaimer - Click2Visit Ltd cannot be held responsible for any error, omission or misrepresentation. By using our facilities and features as business tool to promote your business we cannot guarantee an increase in trade for your business.
